Terms of Service
Last updated: 19 October 2026
The short version
- We build, host and look after your website and the tools in your plan, for a monthly or yearly fee.
- You can cancel any time. Your site stays live until the end of the period you've paid for.
- If a payment fails and isn't sorted within 7 days, your website is paused until it's paid.
- We give at least 30 days' notice by email before any price change or required plan change.
- Your logo, photos and text stay yours. Domains we buy for you are ours and included in your plan.
This summary is for convenience. The full terms below are what apply.
1. About us and these terms
These terms are an agreement between you (the business using our services, "you") and Daham Mohammed trading as Stackless ("we", "us"), a sole trader based at 3 Clemens Street, Leamington Spa, CV31 2DW. You can contact us at hello@stackless.co.uk or on WhatsApp at 07585 155557.
Our services are for businesses, not consumers. By starting a free trial, signing up to a plan or paying a setup fee, you confirm you are acting for a business and agree to these terms. If anything we've agreed with you in writing (for example in an email or proposal) differs from these terms, what we agreed in writing applies.
2. What we provide
Depending on the plan you choose, our services can include:
- designing and building your website;
- hosting, security certificates (SSL) and keeping the site up to date;
- online booking, ordering, payments, forms, reminders, review requests and other automations;
- a client account where you can manage billing and request changes;
- support and small updates as described in your plan.
The features included in each plan are shown on our website at the time you sign up. We may improve or change how features work, as long as we don't materially reduce what your plan includes without giving you notice under section 6.
3. Building your website
- We'll agree what your website needs in our initial chat. We aim to have most websites ready within about a week of receiving everything we need from you, but timings are estimates, not guarantees.
- You'll provide your logo, photos, text, prices, opening hours and other details promptly. Delays in getting these to us will delay your launch.
- We'll show you the site before it goes live. Reasonable changes at this stage are included.
- Work that goes beyond your plan (for example a large redesign, many extra pages or a custom feature) will be quoted separately before we start.
4. Free trial
We may offer a free trial (normally 30 days). Your website is live during the trial. Before the trial ends we'll email you to add a payment method. If no payment method is added by the end of the trial, your website will be paused until it is. A setup fee, if one applies, is not part of the free trial unless we've said so in writing.
5. Plans, payment and billing
- Plans are paid monthly or yearly in advance, by card, through our payment provider Stripe. We never see or store your full card details.
- A one-off setup fee may apply, depending on your plan. Setup fees cover work already done and are non-refundable once building has started.
- Your subscription renews automatically at the end of each billing period until you cancel.
- Prices are shown in pounds sterling. We are not currently VAT registered. If we register for VAT, we'll tell you in advance how this affects your price.
- You can update your card, see your invoices and cancel from your client account at any time.
6. Price changes and plan changes
- Price changes. We may change the price of a plan. We'll email you at least 30 days before a new price applies to you, telling you the old price, the new price and the date it starts. If you don't want to continue at the new price, you can cancel before that date.
- Plan changes. You can't switch plans yourself in your client account. If you'd like a different plan, ask us and we'll arrange it.
- Required upgrades. If your website or business grows beyond what your plan covers (for example much higher traffic, more pages, more staff or locations, or features from a higher plan), we may ask you to move to a more suitable plan. We'll explain why and give you at least 30 days' notice by email before the new price applies. If you don't want to upgrade, you can cancel before that date instead.
7. Late or failed payments
- If a payment fails, we'll email you and our payment provider will retry automatically. Your website stays live for a grace period of 7 days.
- If payment still hasn't been made after the grace period, your website will be paused. Visitors will see a "temporarily unavailable" message instead of your site.
- As soon as payment is made, your website is restored automatically.
- If an account stays unpaid for 60 days, we may end your service under section 13 and remove your website and data.
8. Domain names
- Domains we register. If we find and register a domain name for your website, we pay for it, it is registered to us and remains our property. Its renewal is included in your plan while you're a client.
- Domains you already own. If you already own a domain, it stays yours. You (or your provider) remain responsible for paying for and renewing it. We'll only ask you to point it at our platform.
- When your service ends, domains registered by us stay with us. We may agree to transfer one to you, at our discretion and for a fee we'll tell you in advance.
9. Who owns what
- Your content. Your logo, photos, text, prices and other material you give us remain yours. You give us permission to use, copy and adapt them to build, run and improve your website and services while you're a client.
- Our platform. The design, code, templates, systems and tools we use to build and run your website belong to us (or our suppliers). Your plan gives you the right to use them while you're a client, but it doesn't transfer ownership of them to you.
- When you leave. On request, within 30 days of your service ending, we'll send you a copy of the content you gave us (such as text and images). We don't hand over our code, templates or systems.
- Unless you ask us not to, we may mention that we built your website and show it in our portfolio.
10. Your responsibilities
You agree that:
- you have the right to use everything you give us (including photos, logos and text), and it doesn't break anyone else's rights;
- the information on your website is accurate, legal and not misleading, and your business follows the laws that apply to it;
- you won't use our services for anything illegal, harmful, abusive or for spam;
- you're responsible for how you use the data of your own customers collected through your website (see section 12);
- you'll keep your client account login secure and tell us promptly if you think someone else has accessed it.
We may remove content or pause a website straight away if it breaks the law or these terms, or if we receive a credible legal complaint about it. We'll tell you why.
11. Support, changes and availability
- Small updates (such as new prices, opening hours, photos or a new offer) are included, within reason, as described in your plan. Larger requests will be quoted first.
- We aim to reply to messages within one working day.
- We host on reliable infrastructure and take reasonable care to keep your website online and secure. We can't promise it will never be unavailable, for example during maintenance or problems with our hosting, payment or other providers, which are outside our control.
12. Data protection
How we use your personal information, and that of people who contact us, is explained in our Privacy Policy.
When your website collects information from your customers (for example bookings, orders or enquiry forms), you are the "controller" of that data and we process it on your behalf as your "processor" under UK data protection law. When we do this, we will:
- only use it to provide our services to you and in line with your instructions;
- keep it confidential and secure, and make sure anyone who handles it is bound to confidentiality;
- only use trusted providers to help us (such as our hosting and email providers), under suitable data protection terms;
- help you respond to requests from your customers about their data, and tell you without undue delay if we become aware of a data breach affecting it;
- delete or return it when our service to you ends, unless the law requires us to keep it.
You're responsible for having a lawful reason to collect your customers' data and for telling them how you use it, for example in a privacy notice on your website. We can help you set one up.
13. Cancelling and ending the service
- You can cancel at any time from your client account or by messaging us. Your website stays live until the end of the period you've already paid for, and you won't be charged again. We don't refund part-used periods.
- We can end your service by giving you at least 30 days' notice by email.
- We can end your service straight away if you don't pay what you owe after the steps in section 7, if you seriously or repeatedly break these terms, or if you use our services unlawfully.
- When the service ends, your website will be taken offline. Sections 8, 9, 14 and 16 continue to apply.
14. Our liability to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited.
- We're not liable for loss of profits, sales, business or goodwill, or for any indirect or consequential loss.
- We're not responsible for problems caused by things outside our reasonable control, or by your content, your instructions or third-party services you choose to use.
- Otherwise, our total liability to you for everything arising out of these terms in any 12-month period is limited to the total fees you paid us in that period.
15. Changes to these terms
We may update these terms from time to time. If a change materially affects you, we'll email you at least 30 days before it applies. If you keep using our services after that date, the updated terms apply. If you don't agree, you can cancel before then.
16. General
- We'll contact you by email, WhatsApp or through your client account, using the details you gave us. Please keep them up to date.
- You may not transfer this agreement to someone else without our agreement. We may transfer it to another business that takes over our services, and we'll tell you if we do.
- If any part of these terms is found to be unenforceable, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
